What does California B&P Code §7159 require in a home improvement contract?
California Business & Professions Code §7159 requires that a residential home-improvement contract be in writing and include: the heading “Home Improvement Contract,” the contractor’s name, address, and CSLB license number, a description of the project and materials, the total contract price, a down payment no greater than $1,000 or 10% of the price (whichever is less), a schedule of progress payments tied to completed work, the statutory Mechanics Lien Warning, a CSLB complaint notice, and notice of the buyer’s three-day right to cancel. Contracts missing these elements expose the contractor to discipline by the Contractors State License Board.
Are electronic signatures legally valid on California home improvement contracts?
Yes. Electronic signatures are legally binding on California home-improvement contracts under the California Uniform Electronic Transactions Act (UETA, Civil Code §1633.1 et seq.) and the federal E-SIGN Act (15 U.S.C. §7001). How much can a California contractor collect as a down payment?
For home-improvement work, California law caps the down payment at $1,000 or 10% of the total contract price, whichever is less (§7159(d)(8)). For example: on a $55,000 remodel the maximum down payment is $1,000, and on an $8,000 job it is $800.
